§ 152.157. DUTIES OF BOARD OF ADJUSTMENT AND APPEALS.

  • (A) The Board of Adjustment and Appeals has the following powers and duties with respect to the zoning code.
    (B) (1) To hear and decide appeals where it is alleged that there is an error in any order of requirement, decision, or determination made by an administrative officer in the enforcement of the zoning code;
    (2) To hear requests for variances from the literal provisions of this chapter in instances when their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and to grant the variances when it is demonstrated that the actions will be in keeping with the spirit and manner of this chapter.
